The Restriction of the Use of Certain Hazardous Substances in Electrical and Electronic Equipment Regulations 2012

SI 2012/3032, as amended

Electrical and electronic equipment placed on the GB market must stay within limits for 10 substances, with technical documentation, a declaration of conformity and a UKCA or CE mark. CE is accepted in GB while EU and GB requirements stay the same, but not where an EU exemption has no GB equivalent.

Who is covered

Manufacturers, authorised representatives, importers (UK-based) and distributors, including retailers, of electrical and electronic equipment placed on the GB market. No size thresholds.

Your duties

  • Keep cadmium at or below 0.01 %, and lead, mercury, hexavalent chromium, PBB, PBDE, DEHP, BBP, DBP and DIBP at or below 0.1 % each, by weight in homogeneous material
  • Manufacturer: technical documentation, declaration of conformity, UKCA or CE mark, name and address on the product
  • Keep technical documentation and the declaration for 10 years after the last item is placed on the market
  • Importer: keep a copy of the declaration, check marking and documents, add your name and address, keep a register of non-conforming and recalled products
  • Distributor: check marking and details; do not supply equipment you believe does not comply
  • Use only exemptions that exist in the GB list; time-limited exemptions lapse at expiry
